各县、区人民政府,市级各部门,广元经济开发区、市天然气综合利用工业园区管委会:
《广元市税收征管保障暂行办法》已经市政府同意,现印发给你们,请遵照执行。

广元市税收征管保障暂行办法
第一条 为构建税收征管保障机制,规范税收征纳行为,维护纳税人的合法权益,促进经济和社会和谐发展,根据《税收征收管理法》等法律法规的规定,结合广元实际,制定本办法。
第二条 本办法所称税收征管保障,是指有关部门、单位依法实施监督和协助管理,向税务部门提供涉税信息等支持协助税务机关开展税收征管工作措施的总称。
第三条 税收征管保障的机制构建,以税收征管法律、法规为依据,以“政府领导、税务主管、部门配合、社会参与”为原则,以部门联动、综合治理、源头控管为主要方式,以依法治税、应收尽收为目标。
第四条 广元市税收征管保障工作领导小组负责全市税收征管保障工作的统筹、协调和领导,具体事务由税收征管保障领导小组办公室承担。
各县区人民政府、广元经济开发区管委会应当加强对税收征管保障工作的组织领导,督促有关部门和单位落实税收征管保障措施,对税收征管保障工作情况进行检查和考核。
第五条 税务部门应当发挥税收征管保障的主导作用,加强税收征收管理,优化纳税服务,依法组织税收收入。根据经济和社会发展情况,提出修改有关部门和单位提供涉税信息以及协助税收管理的意见。
第六条 政府部门、有关单位应当按照国家法律、法规有关规定向税务机关提供涉税信息,支持、协助税务机关及其工作人员履行职责。
第七条 依托电子政务外网建立全市统一的经济税收公共信息共享平台。县区人民政府、广元经济开发区管委会应当健全相关部门之间的经济税收公共信息共享制度,逐步实现互联互通。
第八条 政府部门和公用事业企业单位应当确定相应机构及人员,通过经济税收公共信息共享平台,按照下列规定将本部门、单位涉税信息如实提供给税收征管保障领导小组办公室:
(一)发展改革部门及时提供年度重大建设项目计划信息;按季提供投资建设项目立项批复信息,建设项目招标中标信息,《煤炭经营许可证》核发信息。
(二)经济和信息化部门按季提供软件企业和软件产品认定信息,企业改组改制及破产信息,大中型企业技术改造项目信息。
(三)教育部门按季提供新办各类民办学历教育、民办非学历教育、民办托儿所、民办幼儿园等项目信息。
(四)科技和知识产权部门及时提供高新技术企业认定信息;按季提供专利、创意设计登记备案信息,专利技术合同认定登记信息,科技成果和专利权转让信息,科技补贴拨付信息。
(五)公安部门按月提供种经营监管、机动车车辆登记使用、入境人员登记、印章管理信息;按季提供打击虚开发票和假发票等涉税违法行为信息,《特种行业许可证》核发、变更、注销信息,特定行业购销火工产品审批信息。
(六)民政部门按季提供福利企业资格认定、年检信息,社会团体、基金会、民办非企业、宗教活动场所等非营利社会组织的登记、变更、注销信息;按年提供地名命名更名信息。
(七)司法部门按季提供律师事务所、法律服务所、公证处及司法鉴定机构登记、变更及注销信息,办理公证事项的相关信息;按年提供律师从业信息。
(八)财政部门按季提供政府采购中标及支付信息,涉及纳税人的财政补贴、奖励项目及拨付信息,财政拨款建设项目及拨款明细信息,集中支付的大额发票票面信息。
(九)人力资源和社会保障部门按季提供《就业失业登记证》的核发信息,向营利性医疗机构、药店支付医药费的分户信息,《企业实体吸纳下岗失业人员认定证明》核发、年检信息,劳动和就业培训教育机构登记、变更、注销信息。
(十)国土资源部门及时提供国有土地使用权出让、转让信息,土地整理项目信息;按季提供土地征用信息,《采矿许可证(非煤矿山)》核发、年检及出让、转让等权属变更信息,固体矿产资源储量核实信息,《建设用地批准书》核发信息。
(十一)规划建设和住房部门按季提供《建筑工程施工许可证》核发信息,市政建设项目及资金支付信息,商品房预售许可信息,商品房网上签约及备案信息,房屋登记信息,市政建设配套费等信息。
(十二)交通运输部门按季提供本级直接管理的交通建设项目及资金支付信息;运管部门按季提供车辆营运证及车辆维修资格证核发、变更信息;航务管理部门按季提供船舶营运证核发信息。
(十三)水务部门按季提供水利建设项目及资金支付信息,河砂竞标拍卖及产量核定等信息。
(十四)农业部门按季提供农业建设项目及资金支付信息,农用车辆登记信息,农机经营网点及补贴发放信息。
(十五)林业和园林部门按季提供林木采伐许可证、准运证核发信息,林业和园林建设项目及资金支付等信息。
(十六)商务部门按季提供对外贸易经营者备案登记信息,外商投资企业登记信息,外国企业和外籍个人转让商标权、专利权、非专利权技术所有权或者使用权的信息,特定项目经营网点及补贴发放等信息。
(十七)文体和新闻出版部门在大型营业性演出、商业性体育比赛或者其它重要文化体育活动前10个工作日内提供活动的相关信息;按季提供音像、歌舞厅、网吧等行业《文化经营许可证》核发、变更及注销信息。
(十八)卫生部门按季提供医疗机构设置审批、变更、注销信息,营利性、非营利性医疗机构认定等信息。
(十九)审计部门按季提供被审计单位少缴税款以及发票违法违章信息,受托代征单位截留挪用代征税款等信息。
(二十)环保部门按季提供节能节水和环境保护建设项目及资金支付信息。
(二十一)安监部门按季提供非煤矿山企业、危险化学品、烟花爆竹生产企业《安全生产许可证》核发、变更、注销等信息。
(二十二)统计部门按季提供本地区规模以上工业企业总产值、产品销售收入、成本、费用、利润信息,本地区社会商品零售总额、本地区固定资产投资额、分行业的利润率和本地职工平均工资等信息。
(二十三)粮食部门按季提供粮食收储经营企业审批等信息。
(二十四)食品药品监管部门按季提供餐饮服务许可信息,《药品经营许可证》核发、变更、注销信息,医疗机构生产自制药品信息。
(二十五)招商部门按季提供招商引资项目信息。
(二十六)国资部门按季提供监管企业分离、兼并、划转、改组改制信息,技术改造项目等信息。
(二十七)煤管部门按季提供《煤矿开采许可证》核发、年检及出让、转让等权属变更信息,煤炭企业计划产量、开采数量等信息。
(二十八)住房公积金管理部门按年提供住房公积金缴存单位超比例提取、缴纳及贷款发放等信息。
(二十九)工商部门按季提供登记注册、变更、年检、注销、吊销等信息,股权变更、转让及其各方明细登记信息。
(三十)质监部门按季提供企业、事业单位、社团组织及民办非企业单位的组织机构代码证登记、变动信息。
(三十一)人民银行按季提供纳税人开户信息,售汇、付汇、收汇明细信息。
(三十二)银监局按季提供金融机构登记、变更、注销信息。
(三十三)残疾人联合会按季提供残疾人安置信息。
(三十四)电力部门按季提供供电建设工程项目及资金支付信息,本地发电企业上网电量、电价等信息;水、电、气等经营单位按季提供特定纳税人水、电、气耗用量等信息。
(三十五)各类财产保险公司按季提供财产保险理赔中大额维修发票信息;民爆公司、盐业公司、烟草批发企业、成品油批发企业、药品批发企业按季提供商品销售(批发)等明细信息。
(三十六)上述部门、单位及其它部门应当按照税收征管保障领导小组的要求,向税收征管保障领导小组办公室提供税收征管需要的其它涉税信息。
上述部门和单位当期未产生信息的,实行零报送制。税务机关应当做好提供涉税信息的辅导工作。
第九条 第八条规定的应及时提供涉税信息的,在信息发生后的2个工作日内提供;按月提供涉税信息的,在次月10个工作日内提供;按季提供涉税信息的,在下一季度首月15个工作日内提供;按年提供涉税信息的,在次年1月底前提供。
第十条 政府部门和有关单位在各自职责范围内,协助税务机关做好以下税收管理工作:
(一)公安部门与税务机关建立工作协调机制,共同打击逃税、骗税、抗税等税收违法犯罪行为,及时查处税务机关移送的涉税犯罪案件及其它涉税违法线索,并将查处结果通报税务机关;协助税务机关查询纳税人以及其他涉税人员身份证明、境内外人员出入境记录等信息;协助税务机关实施阻止欠税人出国离境措施;及时依法处理阻挠税务人员依法执行公务的行为。
(二)科技和知识产权部门及时查处涉嫌虚报研究开发费用、伪造技术合同及骗取高新技术企业资格的案件,并将查处结果通报税务机关。
(三)民政部门及时查处涉嫌骗取福利企业资格的案件,并将查处结果通报税务机关。
(四)司法部门协助税务机关加强对全市法律服务机构的税收管理。
(五)财政部门协助税务机关查询行政事业性收费情况;按照规定在年度预算中安排国家、省、市级人民政府规定的有奖发票兑奖、涉税举报经费和代扣代缴、代收代缴、委托代征的手续费;及时移送财政财务监督检查中发现的涉税违法行为;在拨付政府投资性项目资金时,督促建设单位按规定缴纳税费;监督预算单位执行发票管理规定,协助税务机关查处预算单位的发票违章行为。
(六)人力资源和社会保障部门协助税务机关查询《就业失业登记证》核发、社保缴纳等信息。
(七)国土资源部门协助税务机关依法查询、查封纳税人以及其他涉税人员的土地使用权;对税务机关委托拍卖或者变卖纳税人以及其他涉税人员的土地使用权的,协助办理过户手续;对申请办理矿产、土地权属变更手续的单位和个人,发现不能提供正式发票、完税证明或者不征税证明的,责成其向税务机关结清税款后再予办理。
(八)规划建设和住房部门协助税务机关查询招标合同备案、房屋销售合同备案情况;协助税务机关依法查询、查封纳税人以及其他涉税人员的房产;对税务机关委托拍卖或者变卖纳税人以及其他涉税人员的房产所有权的,协助办理过户手续;对申请办理房产权属变更手续的单位和个人,发现不能提供正式发票、完税证明或者不征税证明的,责成其向税务机关结清税款后再予办理。
(九)审计部门将被审计对象是否依法履行税收缴纳义务、遵守发票管理法规作为必审内容;及时移送审计工作中发现的涉税线索,并提供相关的审计资料;税务部门对审计部门移送的涉税事项应当及时清收,并将清收结果及时反馈审计部门。
(十)煤管部门在办理有关煤炭生产许可证件转让、变更时,审核契税、营业税、所得税、印花税等相关税款是否已足额缴纳,凡无税收完税证明的,责成其向税务机关结清税款后再予办理。
(十一)工商部门对申请办理工商注销登记的企业、个体工商户,发现不能提供税务登记注销证明的,告知申请人先到税务机关办理相关手续后再予办理;对税务机关依法函请同级工商部门吊销企业、个体工商户营业执照的,工商部门依法办理吊销手续。
(十二)有关银行和金融机构协助税务机关依法查询从事生产、经营的纳税人的账户开立、变更和注销情况;协助税务机关依法对纳税人采取税收保全或强制措施。
(十三)上述部门、单位及其它部门、单位,按照税收征管保障工作领导小组的要求,协助税务机关依法查询其它涉税经济信息,开展其它税收管理工作。
第十一条 政府部门和有关单位对取得的付款凭证应当严格审核,查验真伪,凡不符合规定的票据,不得作为报销凭证。对于税务机关提请代扣代缴税款的,给予协助。
第十二条 税务机关根据有利于税收控管和方便纳税的原则,根据国家有关规定,可以对零星分散、异地缴纳、便于源头控管的税收实行委托代征,有关部门、单位应当给予支持和协助。
受托代征税款的单位代征税款时,应当出示委托代征证书并开具税收票证或证明。纳税人拒绝的,及时告知税务机关。
第十三条 税收征管保障领导小组办公室对有关部门和单位提供的涉税信息应当科学分析、综合利用,不得用于税收管理之外的其它用途。对涉及国家秘密、商业秘密、个人隐私的信息,应当予以保密。
第十四条 政府部门需要调取经济税收公共信息共享平台及税务机关的有关信息时,税收征管保障领导小组办公室同意后无偿提供。
第十五条 市政府目标管理办公室会同市税收征管保障工作领导小组办公室定期对各部门、单位参与税收征管保障工作情况进行专项督查。
县区人民政府、广元经济开发区管委会定期对本级税收征管保障工作情况和成效进行考核。考核的内容主要包括:
(一)有关部门和单位提供涉税信息情况;
(二)有关部门和单位协助税收管理情况;
(三)受托代征税款的单位代征税款情况;
(四)有关部门和单位作为扣缴义务人扣缴税款的情况;
(五)税务机关通过税收征管保障措施,组织税收收入情况。市人民政府、县区人民政府、广元经济开发区管委会对税收征管保障工作考核优秀的单位和个人予以表彰和奖励。
第十六条 有关部门和单位违反本办法规定,未及时提供涉税信息,未能有效协助管理,造成税收损失的,税务机关应当报告本级人民政府,由本级人民政府依据有关规定对有关部门及其责任人员作出处理。
第十七条 法律、法规另有规定的,从其规定。
第十八条 本办法实施中的具体问题由市财政局会同市国税局和市地税局解释。
第十九条 本办法自发布之日起30日后施行。

The quorum for a meeting of the Commission shall be 4 directors

The Commission may appoint any person to be a member of any

remuneration and allowances and shall hold their employment on

The Commission may make arrangements for or in respect
